Hiring of Filipino workers
Accreditation Process, Templates and Checklist 

 

Thank you for your company’s interest in hiring workers from the Philippines.

 

IMPORTANT NOTICES: 

 

1. No placement fee collection from applicants bound to the Czech Republic, Poland, Latvia, Lithuania and Estonia, pursuant to host countries regulations . 

 

2. Accreditation of companies hiring masseuse or massage therapists is on hold while undergoing review. 

 

We are pleased to share with you the attached checklist containing the list of documents, information  to be reflected in the documents and a detailed procedure on how to submit the documents to the Migrant Workers Office in Prague. To expedite the process, we will no longer review applications submitted via email. Templates of accreditation documents and checklist are provided for reference. 

 

For a foreign company to be authorized to hire, employ, or recruit Filipino workers, they must be accredited with a Philippine Recruitment Agency (PRA) with a valid license issued by the Department of Migrant Workers (DMW) or the Philippine Overseas Employment Administration (POEA).

Section 126.Ban on Direct Hires, Exemption of the DMW Rules provides: No employer shall directly hire an OFW for overseas employment, unless otherwise exempted by law of any issuance of the Department. 

The following are the documentary requirements for Accreditation of Principal/Employer to Recruit Skilled Workers/Professionals:

  1. Letter of Intent

    • Address the letter to Labor Attaché Llewelyn D. Perez, Migrant Workers Office-Prague;

    • Indicate the nature of transaction requested from the office:

    • E.g. “To apply for Initial Accreditation” or “To renew expired Accreditation with (name of Philippine agency)"

    • Sign and specify your contact information (mobile and email address)

  2. Company Profile or a Letter (in the letterhead of the company) stating all the following information:

    • Name of company:

    • Complete office address, postal code:

    • Name of owner:

    • Name of contact person/ HR Manager:

    • Mobile and telephone number:

    • Email address of owner/ contact person/ HR Manager:

    • Business activities:

    • Number of years in operation:

    • Number of local and foreign workers. 

  3. Job Order (JO) 

    • Indicating the manpower request(s) of the employer to the Philippine Recruitment Agency (specify the name of agency);

    • List the actual positions, the number of workers required per position, the gross and net salary in the currency to be received by the workers, food allowance, free accommodation or allowance, and other allowances (if any).

  4. Master Employment Contract

    • in English or with English translation

    • SIGNED ON ALL PAGES BY THE PRINCIPAL'S AUTHORIZED SIGNATORY

    • Note: Be sure to fill up the required information in the Master Employment Contract. State the exact address on the space “site of employment”, the employee’s position, and salary (net and gross); if with multiple job positions and salaries indicate as per approved job order; number days of annual vacation and sick leave; indicate if FREE food and accommodation; indicate the increase in percentage of the pay during overtime, work on rest days, holidays, etc. DO NOT LEAVE BLANK ANY OF THE REQUIRED INFORMATION EXCEPT THE NAME OF THE WORKER. 

  5. Recruitment Agreement

  6. Special Power of Attorney signed by the principal in favor of the PRA.

  7. Valid commercial registration or business license that establishes the legal personality of the principal/ FRA/ FRA (Local and English translation copies).

  8. National/Residence ID of the principal's authorized signatory

  9. Passport copy of the Philippine Recruitment Agency's owner

  10. Five (5) photos of the principal’s (employer or agency) office, especially the front view showing the business name.

  11. Five (5) photos of the workers’ accommodation/s with description: indicate the number of bed capacity, number of rooms, size of each room in square meters, and the number of occupant/s per room.

  12. (Other) If there are Filipino workers currently working in the company, submit the list of names of Filipino workers, number of months/years they are working in the company, and their contact numbers / email address.

ADDITIONAL JOB ORDER

 

I.DOCUMENTARY REQUIREMENTS

 

1.Job order indicating the positions, the number of positions required and salary per position.

2.Master employment contract written in English, SIGNED ON ALL PAGES BY THE PRINCIPAL'S AUTHORIZED SIGNATORY;

3.Copy of National/Residence ID of the principal's authorized signatory;

 

ADDITIONAL REQUIREMENTS if the principal is a placement agency representing the employer:

4.Copy of valid commercial registration or business license of the employer;

5.Master employment contract MUST BE SIGNED JOINTLY ON ALL PAGES BY THE AUTHORIZED SIGNATORY OF THE AGENCY AND THE EMPLOYER;

6.Manpower request from the employer addressed to the foreign placement agency/staffing.

7.Copy of National/Residence ID of the employer’s authorized signatory; and

 

 

FOR DIRECT HIRE 

In general, foreign employers may not directly employ Filipino workers for overseas jobs unless processed through DMW or a government‑licensed agency.

Exemptions to the ban on direct hire:

Only the following employer categories are allowed to directly hire:

  1. Diplomats/member of the diplomatic corps.

  2. Members of International organizations.

  3. Heads of state or government officials with at least deputy minister rank.

  4. Other employers approved by the DMW Secretary, including:

Lower rank diplomats or international organization staff endorsed by the Migrant Workers Office (MWO) or head of mission.

Professional or skilled workers: must have a verified/authenticated contract exceeding DMW standards, and hiring must be limited to five (5) workers on first deployment.

Relatives/family members (who are permanent residents abroad) hiring their family, except live in domestic helpers.

SKILLED/HIGHLY PROFESSIONALS:

DOCUMENTARY REQUIREMENTS:

1. Original Contract in English, which must be SIGNED BY THE EMPLOYER ON ALL PAGES. Should be the Standard Employment Contract as mandated by the DMW; otherwise, submit a duly signed Addendum (Addendum to EC-Template) or OFW Compulsory Insurance (OFW Compulsory Insurance)

​2. Copy of the passport of the worker with at least six months validity

3. Copy of visa (if available) visa approval of the worker.

4. Copy of passport or Residence ID of the employer/authorized representative

5. Copy of valid commercial registration/business license of the employer in local language and English

6. Copy of Affidavit of Undertaking to Monitor worker. (Affidavit of Undertaking to Monitor-Direct Hire).

7. Copy of Request for Exemption from the ban on direct hire. (Letter for Exemption on Ban on direct hire).

 

DOMESTIC WORKER/HOUSEHOLD SERVICE WORKER 

DOCUMENTARY REQUIREMENTS:

1. Original Contract in English, which must be SIGNED BY EMPLOYER ON ALL PAGES.

(Standard-Employment-Contract-HSW-DIRECT HIRE).

2. Copy of the passport of the worker with at least six months’ validity

3. Copy of visa (if available) or visa approval of the worker.

4. Copy of passport or Residence ID of the employer/authorized representative

 

 

FOR AGENCY HIRED DOMESTIC WORKER/HOUSEHOLD SERVICE WORKER 

DOCUMENTARY REQUIREMENTS:

1. Original Contract in English , which must be SIGNED BY THE EMPLOYER ON ALL PAGES.

(Standard-Employment-Contract-HSW-WITH PRA).

2. Copy of the passport of the worker with at least six months’ validity

3. Copy of visa (if available) visa approval of the worker.

4. Copy of passport or Residence ID of the employer/authorized representative

5. Recruitment Agreement between the Principal and Agency

6. Job order indicating the position, the number of position required and salary;

7. Copy of the passport of agency owner

8. Certification from the local police that the employer or any of his immediate family members has no criminal record and has not been implicated in any case of abuse.

9. Employer’s Info Sheet, and

10.Proof of employment/income of the principal/employer.

 

 

FOR HIRING OF SEA BASED FILIPINO WORKERS

DOCUMENTARY REQUIREMENTS:

  1. Special Power of Attorney (SPA) or any other equivalent document issued by the principal/employer, specifically authorizing the licensed manning agency to recruit for and in its behalf;

  2. Manning agreement containing, among others, the responsibilities of both principal/employer and manning agency with respect to the employment of seafarers;

  3. Valid business license or registration certificate translated in English indicating the line of business of the principal/employer or equivalent document or proof of existence of business validated or certified by the issuing authority in the host country;

  4. Board Resolution or Secretary’s Certificate authorizing an official of the principal/employer to sign the manning agreement and SPA in behalf of the company;

  5. List of ships together with the individual certificates of vessel registry (CVR) or an equivalent document;

In case of a new building ship, a certificate from the ship builder/owner certificate that the ship is under construction, and an affidavit of undertaking of the licensed manning agency to submit the CVR;

6.Crew complement and their corresponding wage scale; and

7.Copy of National/Residence ID of principal who is the signatory to the contract

​​PROCEDURES:

  1. Prepare all the documentary requirements per above list:

    • ensure all letters/ agreements are affixed with ORIGINAL signatures (signed by pen/wet ink; electronic signatures are NOT acceptable)

    • arrange the documents in the order listed above;

    • avoid using staple wires, adhesives or permanent binder rings on the documents; paper clips or removable binder clips are acceptable

  2. Send the complete set of documents and printed copies of other attachments to MWO Prague by delivering them via courier, with complete address below:

  3. MWO will acknowledge receipt of the documents via email.

  4. The documents will be evaluated.

  5. If documents are found complete and in order:

    • The applicant will be informed via email to proceed to the next step for approval and be given payment instructions.

    • Once the payment is credited to the designated bank account, an official receipt will be issued.

    • The applicant will then be instructed via email to arrange for the pick up by the courier of the MWO stamped documents, for their collection and transmission to their Philippine recruitment agency. 

  6. If documents are found to be incomplete or not in order: the application will be disapproved:

    • Applicants will then be advised via email to retrieve their application (pick up by courier), which shall be attached with either a “Notice of Compliance” or “Notice of Denial”.

    • Applicants who receive a “Notice of Compliance” are allowed to resubmit their application within 15 calendar days from the date of MWO’s email notice for them to retrieve their application.

    • Applicants who receive a “Notice of Denial” are given 15 calendar days to submit an original signed letter for reconsideration, starting from the date of MWO’s email notice for them to retrieve their application.
